1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "Buyer") and New England Vitality LLC dba New England Peptide Center ("New England Peptide Center," "we," "us," or "our"), a Massachusetts limited liability company located at 82 Wendell Ave Ste 100, Pittsfield, MA 01201. By accessing or using newenglandpeptidecenter.com (the "Site") or purchasing any product from us, you agree to be bound by these Terms in full.

We reserve the right to modify these Terms at any time. Updated versions will be posted on this page with a revised "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. Buyer Eligibility and Qualified Researcher Requirement

ALL PRODUCTS SOLD BY NEW ENGLAND PEPTIDE CENTER ARE DESIGNATED RESEARCH USE ONLY (RUO).

To purchase from this Site, you must meet all of the following requirements:

  • You are at least 21 years of age.
  • You are a qualified researcher, research scientist, laboratory professional, or you are purchasing on behalf of a legitimate research institution or laboratory.
  • You possess the legal authority to purchase and possess research chemicals in your jurisdiction.
  • You are not purchasing products for personal use, consumption, or any non-research purpose.
  • You understand and accept the Research Use Only designation of every product sold on this Site.
  • You do not reside in a jurisdiction that prohibits the purchase or possession of these products.

By placing an order, you represent and warrant that all information you provide is accurate, that products will be used solely for lawful in-vitro laboratory research, that you possess the knowledge, training, and facilities required to handle research compounds safely, that you will not resell or transfer products to any ineligible person, and that you will comply with all applicable federal, state, and local laws.

Right to Refuse. We reserve the right to refuse or cancel any order, and to terminate any account, where the intended use of a product is unclear, the shipping address does not correspond to a legitimate research setting, the order volume is inconsistent with research use, or a prior violation of these Terms has occurred.

3. Research Use Only (RUO) Designation

All products sold by New England Peptide Center are intended exclusively for in-vitro laboratory research use only. Products are NOT intended for, and must not be used for, human or animal consumption, administration, or application of any kind. Products are not intended for any diagnostic or therapeutic use.

Products sold on this Site have not been evaluated or approved by the U.S. Food and Drug Administration (FDA). They are not drugs, dietary supplements, foods, cosmetics, or medical devices, and they are not manufactured under FDA pharmaceutical protocols.

By purchasing, you acknowledge full responsibility for ensuring that products are used in compliance with their RUO designation. Misuse of RUO products, including but not limited to human or animal administration, is strictly prohibited and may carry serious legal consequences. We reserve the right to refuse service to, and to terminate the accounts of, any buyer we reasonably believe intends to misuse our products.

4. Products, Quality, and Certificates of Analysis

Each product batch is certified prior to sale against a guaranteed minimum of 99.0% chromatographic purity, verified by independent third-party HPLC testing. A Certificate of Analysis (COA) is available for every product and batch upon request.

Sourcing. New England Peptide Center sources research compounds from a global network of qualified manufacturers and suppliers. Individual products may be manufactured domestically or internationally. Regardless of origin, every lot must meet our quality standard of a guaranteed minimum of 99.0% chromatographic purity, verified by independent third-party HPLC testing, before it is offered for sale. Select products are supplied through our sister brand, USA Made Peps, which is also operated by New England Vitality LLC; in those cases the accompanying Certificate of Analysis may bear the USA Made Peps name. Certificates of Analysis are issued as tested and are never altered.

Product descriptions, specifications, and COAs are provided for research reference only. Buyer assumes full responsibility for assessing the suitability of any product for its intended research application.

5. Orders, Payment, and Pricing

Order Acceptance. Your order constitutes an offer to purchase. All orders are subject to our acceptance, and we reserve the right to decline any order for reasons including eligibility concerns, suspected misuse, pricing errors, or product unavailability.

Pricing. All prices are listed in U.S. dollars and are subject to change without notice. The price in effect at the time you submit your order applies. We are not responsible for typographical errors and reserve the right to cancel any order placed at an incorrect price.

Payment. Payments are handled by third-party payment processors. We do not store your full card or account details on our systems.

Sales Tax. Sales tax is applied where required by state law. Buyer is responsible for any applicable taxes, duties, or fees.

6. Shipping and Delivery

  • Orders placed before 12:00 PM EST on a business day are typically processed the same day and shipped the next business day. Orders placed on weekends or holidays are processed the next business day.
  • Shipments are sent via USPS, UPS, or FedEx with tracking information provided by email.
  • Standard domestic delivery typically takes 3 to 7 business days.
  • Orders over $300 qualify for free standard shipping.
  • We ship to U.S. addresses only.

Risk of loss and title pass to Buyer upon delivery to the carrier. Buyer is responsible for providing an accurate shipping address, and we are not responsible for failed deliveries resulting from incorrect address information.

Buyer is solely responsible for compliance with all laws and regulations governing the receipt, possession, and use of research chemicals in Buyer's jurisdiction.

7. Prohibited Uses

You agree that you will NOT:

  • Use any product for human or animal consumption, administration, or application of any kind.
  • Resell, redistribute, or transfer products to any person who does not meet the eligibility requirements in Section 2.
  • Use products or the Site in violation of any applicable law or regulation.
  • Make fraudulent or deceptive representations, including falsifying your research affiliation or intended use.
  • Repackage or relabel products for pharmaceutical, supplement, or consumer resale.
  • Use products in human clinical trials, compounding for human use, or any therapeutic protocol without appropriate regulatory approval.
  • Scrape, harvest, or collect data from the Site.
  • Introduce malware or other harmful code, or damage, disable, or interfere with the Site or other users' access to it.

Violation of this section may result in immediate account termination, order cancellation, and reporting to law enforcement or regulatory authorities.

8. Intellectual Property

All content on the Site, including text, graphics, logos, product names, descriptions, and images, is the property of New England Vitality LLC and is protected by U.S. copyright and trademark law. You may use Site content for personal, non-commercial research reference only. Any unauthorized use of our trademarks, brand, or product names is prohibited.

9. Disclaimer of Warranties

ALL PRODUCTS AND SITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

We expressly disclaim all warranties of merchantability, fitness for a particular research purpose, accuracy, and non-infringement. We do not warrant that products will meet your specific research requirements or produce accurate or reliable results.

Our quality guarantee, a minimum of 99.0% chromatographic purity verified by independent third-party HPLC testing as reflected in the applicable COA, represents the full extent of our product warranty.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEW ENGLAND VITALITY LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED FROM US, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, LOSS OF DATA, OR OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim in the twelve months preceding the claim. In jurisdictions that do not allow certain exclusions or limitations, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless New England Vitality LLC dba New England Peptide Center and its owners, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Site or any product.
  • Your violation of these Terms or any applicable law.
  • Your violation of the RUO designation or the prohibited uses in Section 7.
  • Any false or misleading representation regarding your research affiliation, eligibility, or intended use.
  • Any third-party claim arising from your possession, use, or distribution of products.

This indemnification obligation survives termination of these Terms and your use of the Site.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in the Privacy Policy.

13. Returns, Replacements, and Refunds

Returns, replacements, and refunds are governed by our Shipping and Returns Policy, which is incorporated into these Terms by reference. In summary:

  • Opened or used products cannot be returned.
  • Quality-guarantee claims must be submitted within 7 days of receipt and must be supported by an independent third-party test showing that the product failed to meet its stated purity, identity, or quantity. The remedy for a verified quality failure is replacement or refund.
  • Unopened products in original condition may be returned within 30 days of receipt for store credit.
  • Approved refunds are issued to the original payment method within 7 to 10 business days after verification.

14. Governing Law and Dispute Resolution

Governing Law. These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

Informal Resolution. Before initiating any formal proceeding, the parties agree to attempt in good faith to resolve any dispute through informal negotiation for a period of 30 days.

Binding Arbitration. Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered in Massachusetts in accordance with the rules of the American Arbitration Association.

Class Action Waiver. You agree that any arbitration shall be conducted on an individual basis and not as a class action, and you waive any right to participate in a class action lawsuit or class-wide arbitration.

Equitable Relief. Either party may seek injunctive or other equitable relief in the state or federal courts of Massachusetts to prevent irreparable harm. For any matter not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Massachusetts.

15. Severability and Waiver

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force and effect. Our failure to enforce any provision does not waive our right to enforce it in the future.

16. Entire Agreement

These Terms, together with our Privacy Policy and our Shipping and Returns Policy, constitute the entire agreement between you and New England Vitality LLC dba New England Peptide Center regarding the Site and supersede all prior or contemporaneous agreements, representations, and understandings.
